These Terms and Conditions (“Terms”) govern your access to and use of ShredArmy.com and any related webpages, digital content, fitness programs, nutrition education, online coaching services, memberships, products, communications, and resources offered by [LEGAL BUSINESS NAME], doing business as Shred Army Fitness (“Shred Army,” “we,” “us,” or “our”).
By visiting our website, creating an account, purchasing a program, enrolling in coaching, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or services.
- Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or participate in Shred Army services.
Our programs are intended primarily for adults. We do not knowingly provide online coaching services directly to minors. Any exception must receive our prior written approval and may require the participation and written consent of a parent or legal guardian.
- Shred Army Services
Shred Army may provide:
- Individual or group fitness coaching;
- Strength-training and conditioning programs;
- Kettlebell and traditional gym workouts;
- Nutrition, lifestyle, habit, and accountability coaching;
- Digital courses, ebooks, guides, videos, challenges, and downloadable resources;
- Memberships and subscription-based services;
- Community features, communications, and educational content; and
- Other fitness-related services identified on our website or at checkout.
Specific services, program lengths, prices, coaching access, communication expectations, and included features will be described on the applicable sales page, checkout page, enrollment form, or coaching agreement.
We may modify, improve, replace, suspend, or discontinue portions of our services when reasonably necessary. Material changes affecting a paid service will be communicated when required by law.
- CoachRx and Other Third-Party Platforms
Shred Army currently uses CoachRx to deliver coaching services, workouts, progress tracking, assessments, messaging, documents, and other client resources.
CoachRx is a third-party technology provider and is not owned or controlled by Shred Army. Your use of CoachRx may be subject to CoachRx’s own terms, privacy policy, account requirements, and technology practices.
By enrolling in coaching, you authorize Shred Army to use CoachRx and other reasonably necessary service providers to administer your program and process information you choose to submit, including fitness, lifestyle, nutrition, progress, and communication data.
We are not responsible for outages, interruptions, data loss, security incidents, changes, or other actions caused solely by an independent third-party service provider. We will make reasonable efforts to help address service issues affecting your Shred Army coaching experience.
- Client Accounts and Account Security
You agree to provide accurate, current, and complete information when creating an account or enrolling in a service.
You are responsible for:
- Protecting your passwords and login credentials;
- Maintaining the security of your account;
- Keeping your contact and payment information current;
- Notifying us promptly of unauthorized account activity; and
- All activity performed through your account unless caused by our own misconduct.
You may not share a personal coaching account, paid program, or login credentials with another person.
- Health and Medical Disclaimer
Shred Army provides fitness coaching and general educational information. Unless expressly stated otherwise, Shred Army and its coaches are not acting as physicians, registered dietitians, physical therapists, mental-health providers, or other licensed healthcare professionals.
Nothing on the website, in CoachRx, or in a Shred Army program is intended to:
- Diagnose, treat, cure, or prevent a disease or medical condition;
- Replace advice from a qualified healthcare professional;
- Provide emergency medical services;
- Prescribe medication or change a medication dosage; or
- Provide individualized medical nutrition therapy.
You should consult a qualified healthcare professional before beginning or changing an exercise, nutrition, supplement, weight-loss, or lifestyle program—especially if you are pregnant, nursing, taking medication, using a GLP-1 or other weight-management medication, recovering from an injury or surgery, or living with a medical condition.
Never disregard professional medical advice because of information provided by Shred Army. If you experience chest pain, faintness, severe shortness of breath, unusual dizziness, significant pain, or symptoms of a medical emergency, stop exercising and seek appropriate medical assistance. Call 911 in an emergency.
- Client Responsibilities
You understand that successful coaching depends on accurate communication and your personal participation.
You agree to:
- Provide complete and truthful information about your health, medications, injuries, limitations, experience, equipment, and relevant medical restrictions;
- Inform your coach promptly of material changes to your health or physical condition;
- Follow exercise instructions, safety precautions, and equipment guidelines;
- Use appropriate judgment and stop an activity that causes pain, dizziness, or concerning symptoms;
- Obtain medical clearance when recommended or required;
- Perform exercises in a safe environment using properly maintained equipment;
- Avoid participating while impaired by alcohol, drugs, or any condition that makes exercise unsafe; and
- Accept responsibility for your personal choices and level of participation.
Remote coaching does not allow a coach to physically supervise every workout, inspect every location or piece of equipment, or immediately observe every technique or safety issue. You are responsible for maintaining a safe workout environment and selecting appropriate weights, resistance, intensity, and modifications.
- Assumption of Risk
Physical exercise, strength training, cardiovascular activity, mobility work, nutrition changes, and other fitness activities involve inherent and other risks.
These risks may include muscle soreness, strains, sprains, falls, equipment failure, dehydration, dizziness, fainting, abnormal blood-pressure responses, aggravation of an existing condition, serious injury, disability, or, in rare circumstances, death.
By voluntarily participating in Shred Army services, you knowingly accept and assume the risks associated with exercise and physical activity, including risks that may arise during unsupervised or remotely coached workouts.
To the fullest extent permitted by law, you accept responsibility for injuries or damages resulting from risks inherent in your voluntary participation, except to the extent caused by conduct that cannot legally be waived.
- Separate Coaching Agreement and Liability Waiver
These website Terms do not replace any separate coaching agreement, informed-consent form, health questionnaire, payment authorization, or assumption-of-risk and liability waiver provided through CoachRx or another approved method.
You may be required to review and electronically sign those documents before coaching begins. If these Terms conflict with a signed coaching agreement concerning your specific services, the signed coaching agreement will control for that subject.
- No Guaranteed Results
Individual results vary based on numerous factors, including age, health, genetics, starting condition, effort, consistency, sleep, nutrition, stress, medication, adherence, and other circumstances beyond our control.
Shred Army does not guarantee:
- A specific amount or rate of weight loss;
- Muscle gain or body-fat reduction;
- Visible abdominal definition;
- A particular performance improvement;
- Prevention of weight regain;
- Medical improvement;
- Competition or athletic success; or
- Results within a particular time.
Testimonials, progress photographs, reviews, and success stories reflect individual experiences and are not promises that another person will obtain the same results.
- Nutrition and Supplement Information
Any nutrition, meal-planning, macronutrient, hydration, or supplement information provided by Shred Army is general educational information unless delivered by an appropriately licensed professional acting within their scope of practice.
You are responsible for checking ingredients, allergens, medication interactions, medical restrictions, and supplement safety with an appropriate healthcare professional.
Shred Army does not manufacture third-party supplements and is not responsible for changes made by a manufacturer to a product’s formulation, labeling, availability, or warnings.
- Prices and Payment
Prices, billing frequency, included features, and any applicable trial terms will be presented before purchase.
By submitting payment information, you:
- Represent that you are authorized to use the payment method;
- Authorize the stated charges and applicable taxes;
- Agree to keep your payment information current; and
- Authorize Shred Army or its payment provider to process charges associated with your purchase.
Payment processing may be performed by CoachRx or another third-party payment processor. Shred Army generally does not directly store complete payment-card information.
Failed or declined payments may result in suspended access until the outstanding balance is resolved.
- Subscriptions and Automatic Renewal
When a program or membership is sold as an automatically renewing subscription, the price, billing frequency, renewal terms, trial conversion terms, and cancellation instructions will be disclosed before enrollment.
By affirmatively enrolling, you authorize the applicable recurring charge until you cancel.
You may cancel using the cancellation method disclosed at enrollment, through available account settings, or by contacting us at [CUSTOMER-SERVICE EMAIL].
If you enrolled online, an online cancellation method will be provided as required by applicable law. Cancellation takes effect as described at checkout or in your coaching agreement. Unless otherwise stated, cancellation stops future renewal charges but does not retroactively refund charges already properly incurred.
Any required renewal reminders, trial-expiration notices, price-change notices, and cancellation rights will be provided in accordance with applicable law.
- Refunds
Unless a different refund or cancellation policy is displayed at checkout or included in your signed coaching agreement:
- Fees already paid are nonrefundable;
- Partial months, unused coaching time, missed workouts, and unused digital content are not eligible for prorated refunds;
- Failure to participate does not automatically cancel your enrollment;
- Downloadable products and immediately accessible digital content are final sale once accessed or delivered; and
- Refunds required by applicable law will be honored.
If Shred Army cancels a prepaid service and does not provide a reasonable substitute, we may provide a prorated refund for the portion not delivered.
- Scheduling and Coaching Communication
Coaching response times, check-in schedules, calls, and appointment policies may vary by program and will be communicated during enrollment.
Unless otherwise agreed:
- Coaching communication is not monitored continuously;
- Messages are not an emergency service;
- Missed appointments may be forfeited;
- Rescheduling requires reasonable advance notice; and
- Clients are responsible for completing check-ins and submitting requested information on time.
- Digital Content and Intellectual Property
The Shred Army name, logos, branding, website design, written materials, workouts, program structures, videos, graphics, ebooks, downloads, and other original content are owned by or licensed to Shred Army and are protected by intellectual-property laws.
When you purchase or access our content, you receive a limited, personal, nonexclusive, nontransferable, and revocable right to use it for your own individual fitness and educational purposes.
Unless we provide written permission, you may not:
- Copy, reproduce, republish, distribute, sell, sublicense, or commercially exploit our content;
- Share paid materials, downloads, screenshots, videos, or login credentials;
- Record, duplicate, or redistribute coaching calls or communications;
- Remove copyright, trademark, or ownership notices;
- Use our content to train clients or create a competing program; or
- Present Shred Army content as your own.
Purchasing access does not transfer ownership of any intellectual property.
- Client Content, Photos, and Testimonials
You retain ownership of content you submit, such as messages, check-ins, workout videos, photographs, and progress information.
You grant Shred Army permission to use submitted content only as reasonably necessary to provide your services, maintain business records, communicate with you, and fulfill legal obligations.
Shred Army will not publicly use your name, identifiable progress photographs, testimonial, or personal transformation story for advertising without separate permission. Any media release or testimonial authorization may be withdrawn prospectively as described in that release, although materials already printed or published may not always be fully retrievable.
- Acceptable Use and Community Conduct
You may not use the website, CoachRx communications, or Shred Army communities to:
- Harass, threaten, abuse, impersonate, or discriminate against another person;
- Publish unlawful, defamatory, obscene, or infringing content;
- Promote unsafe conduct or intentionally false health information;
- Transmit malware, spam, or unauthorized advertising;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Scrape, copy, or harvest information without permission;
- Disrupt the operation of the website or services; or
- Violate applicable laws or third-party rights.
We may remove content or suspend access when reasonably necessary to protect clients, coaches, the community, or our business.
- Suspension and Termination
We may suspend or terminate access if you:
- Fail to make required payments;
- Materially violate these Terms or a signed coaching agreement;
- Engage in threatening, abusive, fraudulent, unlawful, or unsafe conduct;
- Misuse or redistribute our intellectual property;
- Create a material safety concern; or
- Interfere with our ability to provide services.
You remain responsible for charges properly incurred before termination. Provisions concerning payment, intellectual property, risk, disclaimers, liability, and dispute resolution survive termination.
- Privacy
Our collection and use of personal information are described in the Shred Army Privacy Policy, which should be posted separately on the website.
When you use CoachRx or another outside platform, that provider’s privacy policy may also apply. You should review the privacy practices of each third-party service you choose to use.
Health and fitness information submitted through coaching platforms can be sensitive. Please use good judgment when deciding what to submit and keep your login credentials secure.
- Third-Party Links and Services
The website may contain links to CoachRx, payment processors, social-media services, product manufacturers, retailers, or other independent websites.
Links are provided for convenience and do not necessarily constitute an endorsement. We do not control and are not responsible for independent third-party content, availability, security, products, terms, or privacy practices.
- Website Availability and Disclaimer of Warranties
We strive to provide accurate and useful information, but fitness and nutrition information develops over time, and website content may contain errors or become outdated.
To the fullest extent permitted by law, the website, digital content, and services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, compatibility with every device, or any particular fitness, health, financial, or personal result.
Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.
- Limitation of Liability
To the fullest extent permitted by applicable law, Shred Army and its owners, coaches, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of—or inability to use—the website, coaching services, digital content, or third-party platforms.
To the fullest extent permitted by law, Shred Army’s total liability for a claim relating to a purchased service will not exceed the amount you paid directly to Shred Army for the service giving rise to the claim during the six months preceding the event.
These limitations do not apply to liability that cannot legally be excluded or limited.
- Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Shred Army and its owners, coaches, employees, contractors, and agents from third-party claims, losses, or reasonable expenses arising from:
- Your unlawful or unauthorized use of the services;
- Content you submit or distribute;
- Your violation of these Terms;
- Your violation of another person’s rights; or
- Your commercial misuse or unauthorized distribution of Shred Army content.
This provision does not require you to indemnify Shred Army for conduct for which indemnification is prohibited by law.
- Dispute Resolution
Before filing a formal legal claim, you and Shred Army agree to make a good-faith effort to resolve the dispute informally.
A written notice describing the dispute and requested resolution must be sent to:
Shred Army Fitness
[LEGAL BUSINESS NAME]
[MAILING ADDRESS]
[CUSTOMER-SERVICE EMAIL]
The parties will have 30 days after receipt of the notice to attempt an informal resolution.
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of California. Any legal action that is not resolved informally will be brought in a court of competent jurisdiction located in Orange County, California, and the parties consent to that location and jurisdiction.
Nothing in this section prevents either party from bringing an eligible matter in small-claims court or requesting temporary relief necessary to protect intellectual-property or confidential information.
- Changes to These Terms
We may update these Terms to reflect changes in our services, technology, policies, or legal obligations.
The updated version will be posted with a revised “Last Updated” date. When legally required, we will provide additional notice and obtain consent before applying a material change.
Your continued use after an updated version takes effect constitutes acceptance of the revised Terms, except where additional consent is required by law.
- Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
- Entire Agreement
These Terms, the Shred Army Privacy Policy, applicable checkout disclosures, and any signed coaching agreement constitute the agreement between you and Shred Army concerning the applicable services.
If a specific signed coaching agreement conflicts with these general Terms, the signed coaching agreement will control for the conflicting subject.
